Divorce Petition - Arnold & Wadsworth

The Divorce Petition is the first legal document that is filed in a divorce action in Utah. There are certain items a divorce petition must contain. First, you will need to state that a controversy exists between the spouses and request the aid of the court to help complete the divorce. Second, the name and age of each child that is under 17 "whose welfare may be affected" by the Divorce. Third, the name and address of the Petitioner (person filing the divorce). Fourth, the name and address Respondent (the spouse). Fifth, you will need to state that the court has jurisdiction over the parties to make the decision.

Other important factors are the reason for the divorce. There are certain reasons you can get divorced in Utah. Some other items that are helpful to the court are a proposed parenting plan (how you will split time with the children) and a child support calculator that has been filled out with the correct incomes.
