DIVORCE - Step 2

Next, you need to file the Petition for Divorce. I will discuss later how to answer a Divorce Petition if one has been filed and served upon you. In order to file for a Divorce you need to be prepared to know where to know where your spouse is in order to serve them with the Divorce Petition or paperwork. You also need to be prepared to pay the filing fee that is required with the court. Depending on where you live whether it be in Salt Lake County, Davis County, or Weber County there is a court house near you that will take your Divorce Petition.

In the Divorce Petition it will discuss and lay out the facts about the marriage. For example, it will state when and where you were married, and how many children you have. The Divorce Petition will also ask for the things you want when your divorce is final. Such things could be how much you want in child support, alimony, or what assets you want. The reason you will ask for these things is because if your spouse does not answer the divorce petition then you get what you have asked for by default. Your spouse will have a certain amount of days to answer the petition depending on where they live.

In your Divorce Petition you will also have to state why you are getting divorced. This could be as simple as stating that you have irreconcilable differences, or that your spouse has left you for someone they met on Facebook. Believe us, when we say we have seen it all.

Once your divorce is filed, then it will need to be served on your spouse. We have great process servers that do this for you. If you have been served with Divorce Papers, you should have also received what is call a Summons. On the Summons it will tell you how long you have to file an Answer to the Divorce Petition. Remember, if you do not Answer the Petition, the court can grant your spouse everything they are asking for in the Divorce Petition.
