Custody
– Active Duty Military Parents
Utah law has provided a parenting plan that enables
parents that are active duty for the military to have a parenting plan in case
of deployment, mobilization, or is ordered to temporary duty at another
location. This is covered under Utah Code Annotated section 30-3-40, which is
titled Custody and Parent-Time when One Parent is a Service Member.
If the service member is a custodial parent and gets
deployed then he/she should first turn to the non-custodial parent in order for
that parent to exercise and provide the parent time for the minor child. If the
service member who is deployed is the noncustodial parent then his/her parent-time
rights may be exercised by a family member with a close and substantial relationship
to the minor child for the duration of the service member’s absence.
